1. Agreement to Terms

By accessing or using the PixWhat mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you do not have permission to access or use the App.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

PixWhat is an AI-powered language learning and photo translation application. The App provides:

• Photo-based text translation using artificial intelligence
• Multi-language support for over 100 languages
• Vocabulary saving and learning features
• Personalized language learning recommendations
• Offline translation capabilities (for downloaded language packs)

3. User Accounts

3.1 Account Creation

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 13 years old to use PixWhat. If you are under 18, you must have parental or guardian consent to use the App.

4. Acceptable Use

4.1 Permitted Use

You may use PixWhat for personal, non-commercial language learning and translation purposes.

4.2 Prohibited Activities

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Upload content that infringes intellectual property rights
• Upload malicious code, viruses, or harmful software
• Attempt to reverse engineer or decompile the App
• Use automated systems to access the App without permission
• Interfere with or disrupt the App's operation
• Collect or harvest user information
• Impersonate others or misrepresent your affiliation
• Use the App to send spam or unsolicited communications
• Upload content containing sensitive personal information of others
• Resell or commercially exploit the service without authorization

5. User Content

5.1 Your Content

You retain ownership of photos and content you upload to PixWhat. By uploading content, you grant us a limited, non-exclusive license to:

• Process your photos to provide translation services
• Store your translations and vocabulary for your personal use
• Use anonymized, aggregated data to improve our services

5.2 Content Responsibility

You are solely responsible for the content you upload. You represent that you have all necessary rights to upload and process the content through our App.

6. Intellectual Property Rights

The App and its original content (excluding user content), features, and functionality are owned by PixWhat and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, and logos may not be used without our prior written consent.

7. Subscriptions and Payments

7.1 Subscription Plans

PixWhat may offer free and paid subscription plans. Paid subscriptions provide access to premium features.

7.2 Billing and Renewal

• Subscriptions automatically renew unless cancelled
• You will be charged through your Apple App Store account
• Prices are subject to change with notice
• Subscription management is handled through the App Store

7.3 Cancellation and Refunds

You may cancel your subscription at any time through your App Store settings. Refunds are subject to Apple's App Store refund policy. We do not provide refunds for partial subscription periods.

While we strive for accuracy, AI-powered translations may contain errors or inaccuracies. PixWhat provides translations on an "as-is" basis:

• Translations are for general understanding and learning purposes
• We do not guarantee 100% accuracy of translations
• Do not rely on translations for legal, medical, or critical decisions
• We are not liable for errors or misinterpretations

To the maximum extent permitted by law, PixWhat and its affiliates shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill

• Translation inaccuracies or misinterpretations
• Unauthorized access to your data

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is less.

You agree to indemnify and hold harmless PixWhat and its affiliates from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any rights of others.

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• At our sole discretion for any reason

Upon termination, your right to use the App will immediately cease. All provisions that should survive termination shall survive, including ownership, disclaimers, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PixWhat operates, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

• Good faith negotiation between the parties
• Mediation if negotiation fails
• Binding arbitration if mediation is unsuccessful

16. Changes to the App

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.

The App may integrate with third-party services (e.g., Apple services, payment processors). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PixWhat regarding the use of the App and supersede all prior agreements.
